Our Experts calculated and rebutted lost profits of a freight broker providing logistics services software after a former executive stole client lists. As with most trade secrets cases, this involved theft of electronic information.  To determine damages, Our Experts calculated the harm that has occurred, by quantifying the benefit received from the stolen trade secrets, and value the technology involved.

Our Experts served as a rebuttal witness on a case involving an oil field services company that manufactures the saltwater solution used as an additive in drilling fluids for the oil and gas industry. The plaintiff, a competitor of our client, believed former employees had stolen their proprietary solution and had stolen one of their largest customers. After addressing the nature of the “secrets” at issue, Our Experts calculated their lost profits by calculating how much of a “head start” the trade secret provides. The Court accepted our conclusions and awarded damages significantly lower than the opposing expert had claimed.

Our Experts were involved in a case where an electrical contractor’s copyrighted architectural drawings were stolen by a former employee who went on to form a competing firm. This competitor was able to underbid on these contracts with the benefit of not recouping their costs and ultimately stole away all future business from several clients. Our Experts calculated lost profits on the contracts that were lost, and future lost profits on the ongoing business relationship.

Our Experts calculated lost profits in a theft of trade secrets claim against the former owner of an insurance brokerage company. Performed regression analyses to examine customer selling patterns on a before-and-after basis for both the plaintiff and the defendant. This allows us to quantify the economic effects the trade secrets had on the product sales of both parties. Our conclusions were used in settlement to negotiate a favorable price in settlement.
